1. Acceptance of Terms

By accessing apexrings.com or using any Apex Rings product or service, you agree to these Terms. If you do not agree, please do not use our products or services. These Terms are a binding agreement between you and Apex rings LLC, 2100 US 301, Palmetto, FL 34221 ("Apex Rings", "we", "us").

2. Eligibility & Territory

You must be at least 18 years old to purchase. We currently sell and ship to the United States only. Use of the site from outside the U.S. is at your own risk and subject to your local laws.

3. Orders & Payment

All orders are subject to acceptance and availability. Prices are listed in USD. We reserve the right to cancel orders for any reason, including pricing errors, with a full refund. Promotional pricing does not apply retroactively to past orders.

4. Health Disclaimer

Apex Rings is a wellness product, NOT a medical device. It is not intended to diagnose, treat, cure, or prevent any disease. Data and insights are for informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before making changes to your health regimen.

5. Warranty, Apex Care & Returns

Each ring carries a 90-Day Limited Warranty against manufacturing defects. The optional Apex Care Protection Plan ($29.99) provides one accidental-damage replacement at 50% off MSRP within 2 years. See our Returns Policy for the 30-day return window. The full terms of each program govern that program.

6. Acceptable Use

You may not use the site to violate any law, infringe any right, transmit harmful code, scrape data without permission, or attempt to gain unauthorized access to our systems.

7. Intellectual Property

All content on this site — text, design, logos, photographs, software — is owned by Apex Rings or our licensors and is protected by copyright and trademark law. You may not reproduce or use it without written permission.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEX RINGS IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OUR PRODUCTS OR SERVICES. OUR TOTAL AGGREGATE LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

9. Binding Arbitration & Class-Action Waiver

PLEASE READ CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS.

You and Apex Rings agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of our products or services will be resolved by binding individual arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in English in the State of Florida, or by phone/video at the consumer's request.

Class-action waiver. You and Apex Rings agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

30-day opt-out. You may opt out of this arbitration agreement by emailing legal@apexrings.com within 30 days of your first purchase, with the subject line "Arbitration Opt-Out" and including your name, order number, and address.

Nothing in this section prevents either party from seeking relief in small-claims court for qualifying claims, or from seeking injunctive relief in court for intellectual property infringement.

10. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. To the extent any claim is not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Manatee County, Florida.

11. Changes

We may update these Terms at any time. Material changes will be posted on this page with an updated "Last updated" date. Continued use after changes constitutes acceptance.
